Gojo Terms of Service

1. Introduction & Acceptance of Terms

Welcome to Gojo(“we,” “us,” or “our”), accessible at gojo.gg. These Terms of Service (“Terms”) constitute a legally binding agreement between you and Gojogoverning your access to and use of our platform, including our draw system, marketplace, physical card redemption features, and all related services (collectively, the “Service”).

By accessing or using the Service, you confirm that you have read, understood, and agree to be bound by these Terms and our Privacy Policy. If you do not agree, do not access or use the Service.

We may update these Terms at any time. Material changes will be communicated via email or in-Service notice. Continued use after changes take effect constitutes acceptance.

Important: These Terms contain a binding arbitration clause and class action waiver (Section 14).

2. Eligibility

To use the Service, you must:

  • Be at least 18 years of age;
  • Have the legal capacity to enter into binding contracts;
  • Not reside in or be subject to any jurisdiction where use of the Service is prohibited by law; and
  • Not be subject to any economic sanctions or restricted party lists.

Gojo reserves the right to request identity verification at any time and to restrict or terminate access for users who do not meet eligibility requirements.

You acknowledge that participation in draws involves randomized outcomes. Digital assets acquired through the Service may fluctuate in value. Nothing on the Service constitutes investment advice or a guarantee of profit.

3. Account Registration

Accounts are created through Privy authentication using email, Apple ID, Google, or a compatible Web3 wallet. Upon registration, you may receive an embedded wallet for holding digital assets and cryptocurrency (including USDC and SOL on the Solana network).

You are solely responsible for maintaining the security of your account credentials and wallet. You must notify us immediately at support@gojo.gg if you suspect unauthorized access. Gojo is not liable for losses resulting from unauthorized account use.

Accounts are personal and non-transferable. You may not sell, transfer, or share access to your account.

4. Description of the Service

Gojo is a hybrid physical-digital collectibles platform focused on trading card games, including but not limited to Pokémon TCG. Core features include:

  • Draws: Randomized card selection events where participants pay an entry fee and receive one or more physical cards.
  • Marketplace: Peer-to-peer buying and selling of physical trading cards.
  • Physical Redemption: Claiming physical cards won through draws, with shipping to your address.
  • Seller Tools: Listing management, payout settings, and draw creation for verified sellers.

5. Draws & Digital Assets

Draws are randomized events. Card allocations are determined at the time of draw completion using cryptographic algorithms designed to ensure fairness. Gojo employs provable fairness mechanisms that allow you to independently verify draw outcomes.

Draw entries are final and non-refundable once a draw is completed and results are determined, except as expressly stated in our refund policy or required by applicable law.

We do not guarantee the availability of specific cards in any draw. Card contents and valuations are provided for informational purposes only and do not constitute guarantees of value.

6. Marketplace

The Gojo marketplace facilitates peer-to-peer sales of physical trading cards. By listing an item, you make a binding offer. Completed purchases are final and irreversible.

Gojocharges a platform fee on completed marketplace transactions, as disclosed at the time of listing. Fair market value data provided through the Service is sourced from third parties and is provided “as is” without warranty of accuracy.

Disputes regarding marketplace transactions must be filed within 7 days of the transaction by contacting support@gojo.gg.

7. Physical Assets & Shipping

Cards won through draws are held by Gojo or its vault partners until claimed. You retain ownership of physical cards associated with your account. Gojo acts as a custodial agent and is not liable for loss or damage caused by third-party vault or shipping partners beyond commercially reasonable efforts.

Shipping fees and applicable taxes are your responsibility at the time of redemption. Shipping addresses must be provided accurately. We are not responsible for delivery failures due to incorrect address information.

Unclaimed cards may be subject to storage fees or forfeiture after extended periods of inactivity. We will provide reasonable advance notice before any forfeiture action.

8. Payments & Fees

Gojo accepts payment via credit/debit card and cryptocurrency (USDC/SOL on the Solana network). All prices are displayed in USD unless otherwise noted.

You are responsible for all applicable taxes on your purchases and earnings through the Service. Draw entries and marketplace purchases are non-refundable once completed, except as required by law. Blockchain transactions are irreversible.

Seller payouts are processed according to our payout schedule.Gojo reserves the right to withhold payouts pending resolution of disputes or suspected fraud.

9. Intellectual Property

All platform content — including logos, design, software, and text — is owned by or licensed to Gojo. You receive a limited, non-exclusive, non-transferable, revocable license to use the Service for personal, non-commercial purposes.

Third-party intellectual property (including Pokémon, Wizards of the Coast, Nintendo, and other card game brands) remains the property of their respective owners. Purchase of a physical card grants you ownership of that card, not the underlying intellectual property.

You may not copy, reproduce, distribute, or create derivative works from Gojo platform content without express written permission.

10. Prohibited Conduct

You may not use the Service to:

  • Engage in fraud, manipulation, or money laundering;
  • Circumvent geographic restrictions using VPNs or proxies to access restricted jurisdictions;
  • Automate interactions with the Service without our written consent;
  • Exploit bugs, provable fairness systems, or other technical vulnerabilities;
  • Harass, threaten, or harm other users or Gojo personnel;
  • Violate any applicable law or regulation; or
  • Create multiple accounts to circumvent restrictions or bans.

Violations may result in immediate account suspension, asset freezing, and reporting to law enforcement.

11. Disclaimers & Limitation of Liability

THE SERVICE IS PROVIDED “AS IS” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT. WE DO NOT GUARANTEE UNINTERRUPTED SERVICE, ACCURACY OF CARD VALUATIONS, OR ASSET VALUE RETENTION.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, GOJO'S TOTAL LIABILITY FOR ANY CLAIM ARISING FROM OR RELATED TO THE SERVICE IS LIMITED TO THE GREATER OF (A) THE AMOUNTS YOU PAID US IN THE 12 MONTHS PRECEDING THE CLAIM OR (B) $100 USD.

Gojo is not liable for losses arising from blockchain network failures, wallet compromise, third-party service outages, or events beyond our reasonable control.

12. Indemnification

You agree to indemnify and hold Gojo and its affiliates, officers, employees, and agents harmless from any claims, damages, or expenses (including legal fees) arising from your use of the Service, violation of these Terms, or infringement of any third-party rights.

13. Termination

We may suspend or terminate your account at any time for violations of these Terms, conduct harmful to users or Gojo, or at the request of law enforcement. Upon termination, you will have a reasonable period (typically 30 days) to claim any physical cards, transfer digital assets, and withdraw wallet balances, subject to applicable law.

You may close your account at any time by contacting support@gojo.gg. Closing your account does not automatically entitle you to a refund of any fees or draw entries.

14. Governing Law & Dispute Resolution

These Terms are governed by the laws of the State of Delaware, without regard to conflict-of-law principles.

Informal Resolution: Before initiating any formal dispute, you agree to contact us at support@gojo.gg and attempt to resolve the issue informally within 60 days.

Binding Arbitration:If informal resolution fails, disputes will be resolved through binding arbitration administered by the American Arbitration Association (AAA) under its Consumer Arbitration Rules, conducted in English. The arbitrator's decision is final and binding. You may opt out of arbitration within 30 days of creating your account by written notice to support@gojo.gg.

Class Action Waiver: All disputes must be brought on an individual basis. You waive the right to participate in class actions or class-wide arbitration.

Exceptions: Either party may seek injunctive or equitable relief in court for intellectual property violations or other matters where irreparable harm is threatened.

15. General Provisions

  • Entire Agreement: These Terms and our Privacy Policy constitute the entire agreement between you and Gojo.
  • Severability: If any provision is found unenforceable, remaining provisions remain in full effect.
  • No Waiver: Failure to enforce any provision does not constitute a waiver of that right.
  • Assignment: You may not assign these Terms. We may assign our rights freely.
  • Limitation Period: Claims must be brought within one year of the event giving rise to the claim.
  • Force Majeure: We are not liable for failures caused by events beyond our reasonable control.
